Pokecut Website Payment Terms

The following "Payment Terms" govern the commercial transactions between you and us, including any paid services you purchase (hereinafter referred to as "Paid Services"). Our Paid Services primarily consist of two categories: (a) Member Subscriptions, which provide credits and other benefits as specified in the plan on a yearly, monthly, or other periodic basis for use with Pokecut Website features; and (b) One-time Credit Purchases, which have a permanent validity period (credits do not expire).

These terms constitute a legally binding contract between you and the Pokecut Website or its related entities, applicable to your purchase of Paid Services (hereinafter collectively referred to as "Pokecut Website" or "we"). Please note that the subject of these Payment Terms is the Pokecut Website and does not include the Pokecut App on platforms such as Apple or Google Play. If you have questions regarding payments for the Pokecut App, please consult the respective platform. If you do not agree to these Payment Terms, please do not complete any Paid Service transactions.

By purchasing Paid Services, you agree to comply with these Payment Terms and consent to receive information electronically as described in the "Communications" section below.

We may update these Payment Terms from time to time. Please review these terms before completing any commercial transaction or renewing a subscription.

1. Contracting Entity

If you purchase Paid Services from us, you are entering into a contract with the Pokecut Website. If you purchase Paid Services through a third-party reseller or payment processor, the contractual relationship regarding your payment is with that third party; however, the Pokecut Website remains responsible to you for the delivery of the Paid Services, subject to your compliance with our Payment Terms, Terms of Service, and Privacy Policy.

2. Communications

You agree to receive all notices, agreements, and other communications related to Pokecut Website products and services electronically, including via email, on-site notifications, SMS, or information posted within the Pokecut Website services. You acknowledge that electronic communications are legally equivalent to written forms.

3. Payment

3.1 General

By selecting a Paid Service and providing payment information, you agree:

● To pay all amounts due by the applicable due date;

● That all payment information you provide is accurate and that you are authorized to use the payment method;

● That we may store your payment information and use the stored information to charge you at the applicable time;

● That we may collect applicable taxes, duties, or other fees related to your purchase, in the currency of the transaction;

● That you are responsible for third-party fees incurred while using Paid Services, including internet connection or platform fees.

3.2 Currency and Taxes

Currency: The transaction currency may include VAT or similar taxes, depending on the applicable jurisdiction. If a specific tax applies but is not collected by the Pokecut Website, you are responsible for paying it yourself.

Tax Responsibility: The price of Paid Services may be displayed as tax-inclusive; however, you are responsible for taxes in your location or the place of use.

3.3 Fee Changes

● We may change the prices of Member Subscriptions or credit purchases, introduce new fees, or modify the terms of Paid Services.

● We will provide advance notice for price changes regarding recurring subscriptions. Price adjustments for the same Paid Service typically take effect at the start of your next billing cycle unless otherwise stated.

● If you do not agree to the new prices or fees, you may choose not to renew the Paid Service, and the non-renewal will take effect at the end of the current billing cycle.

3.4 Billing Methods and Payment Information

● It is your responsibility to ensure that your payment information remains current and accurate. If you are the account holder but not the holder of the payment method, you must inform the Pokecut Website before changing the payment method.

● If a payment method is invalid, expired, or cannot be charged, we may suspend access to Paid Services until the payment issue is resolved.

4. Credits

4.1 Deduction and Usage

● Credits are deducted based on the number of images processed and the features used. Credits are only deducted after a feature successfully processes an image. Applying multiple features to the same image may result in multiple deductions.

● Re-saving or re-processing any unchanged image will not incur additional credit deductions.

● When using credits, you must not upload, download, publish, store, or share any content that violates applicable laws or infringes upon third-party rights.

● We reserve the right to change the number of credits deducted per feature; all adjustments will be explained in these terms. The current specific credit deduction details are as follows:

4.2 Balance and Validity

Your billing interface will display your credit balance within the valid period. Monthly credits included in subscription benefits will reset monthly (on the 1st of each month); unused credits will expire. Expired credits are non-refundable even if unused. If you purchase credits separately (Pay-as-you-go) rather than a subscription, the credits are permanently valid.

5. Automatic Renewal

5.1 Renewal: Subscriptions with automatic renewal will automatically renew your membership at the end of the current billing cycle (to prevent access interruption due to renewal delays), provided you have enabled this feature in your account and maintain a valid payment method.

5.2 Failure to Renew: If renewal cannot be completed due to insufficient funds or payment method issues, your service may be suspended until the payment issue is resolved.

5.3 Trial Cancellation: You may cancel automatic renewal at any time during a trial period. However, if you request a refund after the trial period ends (after the charge has occurred), the credits you consumed during the trial period will be calculated proportionally and deducted from the refund amount.

5.4 Cancellation: You can cancel automatic renewal at any time via "My Orders". Cancellation will take effect at the end of the current billing cycle; issued credits may still be used within the scope permitted by these terms.

6. Refunds and Chargebacks

6.1 Refunds

Refund Policy: We provide refund support for a limited time. You may request a refund within 5 days of payment for a Yearly Subscription, within 3 days for a Monthly Subscription, and within 3 days for Permanent Credits. We will process requests according to these Payment Terms. We generally do not grant refunds after the refund validity period expires. If there are special reasons, please contact us with a reasonable explanation, and we will handle it on a case-by-case basis.

Reasonable Refund Reasons Include: Inability to activate the account after contacting customer service following purchase; duplicate charges caused by platform errors; unauthorized duplicate charges or erroneous renewals; major technical issues occurring within the refund validity period that cannot be resolved; severe data leakage or loss caused by the platform.

Unreasonable Refund Reasons Include: Dissatisfaction with feature results; simply not wanting it after purchase; forgetting to cancel a subscription resulting in a renewal charge; "unauthorized transactions." (Since we provide a free trial, you can decide whether to purchase after testing. Furthermore, payment requires you to select a payment platform and input payment information—such as account, password, card number, security code—to authorize the charge; therefore, the above are considered unreasonable grounds for a refund).

Refund Amount: Within the refund validity period, we will refund the value of the remaining credits in your account based on the unit price at which you purchased them. Additionally, any platform handling fees caused by the refund must be borne by you. For example, using PayPal, the platform fee for a refund is typically 5%~8% of the payment amount.

Example 1: If you use PayPal to purchase a Monthly Ultra Plan for $18.99, receiving 1500 credits, and you have used 200 credits. If you request a refund, the PayPal platform fee of $1.14 is deducted first. We will then refund the remaining credits at a price of approx. $0.0119 per credit, resulting in a refund amount of $15.47.

Example 2: If you purchase a 300-credit plan for $9.99 and use 200 credits. If you request a refund, the PayPal platform fee of $0.74 is deducted first. We will then refund the remaining credits at a price of approx. $0.0308 per credit, resulting in a refund amount of $3.083.

Third-Party Platform Purchases: The Pokecut Website currently does not support purchases via third-party platforms in any form. Any benefits purchased on third-party platforms are not guaranteed by the Pokecut Website, and refunds must be addressed with the respective platform.

6.2 How to Apply for a Refund

Submit a ticket through our website, providing proof of purchase, a description of the issue, and the requested refund amount. We will reply within the specified time according to our service standards.

6.3 Dispute Resolution and Applicable Law

● These Payment Terms and any disputes related thereto shall be governed by the laws of the People's Republic of China.

● If a dispute cannot be resolved amicably, the parties shall submit to arbitration in accordance with the rules of a mutually agreed arbitration institution. The arbitration award shall be final and binding on both parties.

● If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.

6.4 Suspension or Termination of Services

● The Pokecut Website may suspend or terminate your access to Paid Services without notice if you violate these terms, break the law, infringe on third-party rights, or for security/operational needs.

● If services are suspended or terminated due to your breach of contract, refunds will be determined at our discretion and subject to applicable laws and these Payment Terms.

● In the event of termination, you retain the right to access issued and unused credits, provided you comply with the Payment Terms.

6.5 Changing Account Information and Payment Methods

● It is your responsibility to maintain the accuracy and timeliness of your account and payment information.

● If you need to change the payment method and you are not the account holder, please contact Pokecut Website support to verify your authorization before making changes.

6.6 Collection Costs and Chargebacks

● In addition to Paid Services, you agree to pay reasonable collection costs for recovering overdue amounts, including attorney fees and related expenses.

● Overdue amounts may accrue interest as prescribed by applicable law.

● If you initiate a chargeback with your credit card issuer, the Pokecut Website may suspend or limit access to certain features until the issue is resolved and may seek compensation for incurred costs.

6.7 Third-Party Fees

Pokecut Website prices do not include third-party fees (such as internet access fees, mobile data fees, or third-party applications). You are solely responsible for these fees.

7. Data Privacy and Compliance

Our use of your information regarding payments is detailed in our Privacy Policy. By agreeing to these terms, you consent to the collection and use of data as described in the Privacy Policy.

8. Force Majeure

The Pokecut Website is not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, government actions, network interruptions, etc.).

9. Termination of This Agreement

These Payment Terms may be terminated in accordance with the Terms of Service or by written agreement of both parties. Termination does not relieve you of the obligation to pay amounts due for services already provided.
